Welcome to evisajapan.co.uk. These Terms and Conditions (hereinafter referred to as "Terms") govern your access to and use of our website and services.

This website is owned and operated by MigraGlobal Soluciones LTD, a private limited company registered in the United Kingdom under Company Number 16934517, with its registered office at 20 Wenlock Road, N1 7GU, London, United Kingdom.

IMPORTANT NOTICE: By clicking "Submit Application", "Pay Now", or accessing any part of our services, you explicitly acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must strictly cease using this website immediately.

1. Definitions and Interpretation

In these Terms, the following definitions apply:

  • "The Company", "We", "Us": Refers to MigraGlobal Soluciones LTD and its authorized staff.

  • "The Client", "You", "User": Refers to the individual accessing the website or submitting a visa application.

  • "Service": Refers to the professional consultancy, data review, photo compliance check, and submission service provided by the Company.

  • "Consulate" / "MOFA": Refers to the Ministry of Foreign Affairs of Japan or the relevant Japanese Diplomatic Mission.

  • "Government Fee": The official fee charged by the Japanese Government for visa issuance.

  • "Service Fee": The fee charged by MigraGlobal Soluciones LTD for processing the application ($70.00 USD).

2. Nature of Services (Non-Affiliation Disclaimer)

It is vital that the Client understands the nature of our business before proceeding.

2.1. Private Agency Status: MigraGlobal Soluciones LTD is a private, commercial document processing agency. We are NOT affiliated with, endorsed by, or an agent of the Government of Japan. 2.2. The Service Scope: Our service is limited to:

  • Reviewing your data for clerical errors.

  • Formatting your passport scan and biometric photo to meet strict Japanese standards.

  • Submitting your application to the official Japanese Visa System.

  • Providing status updates and 24/7 support. 2.3. Official Channels: The Client acknowledges that they can apply directly through the official Japanese Government website for a lower fee, but they will do so without our professional review or support services.

3. Application Processing & Timelines

3.1. Standard Processing: We offer a standard professional processing service with an estimated completion time of 5 to 9 business days. 3.2. Timeframes are Estimates: While 95% of our applications are processed within this window, we DO NOT GUARANTEE a specific delivery date. Delays may occur due to:

  • Additional security checks by the Japanese Consulate.

  • Public holidays in Japan or the UK.

  • System maintenance on the government portal. 3.3. No Liability for Delays: The Company shall not be liable for any costs incurred (flight changes, hotel cancellations) due to a visa not being issued within the estimated timeframe. We strongly advise against booking non-refundable travel until the visa is in hand.

4. Fees and Payments

4.1. Service Fee: The Client agrees to pay a flat, all-inclusive fee of $70.00 USD per applicant. 4.2. Inclusions: This fee covers the Company’s service charge and the standard Government Assessment Fee (where applicable). 4.3. Payment Authorization: By providing payment details (Credit Card or Crypto), the Client represents that they are authorized to use the payment method. 4.4. Currency: All transactions are processed in USD. The Company is not responsible for foreign exchange fees charged by the Client’s bank. 4.5. Chargeback Policy: The Client agrees not to file a fraudulent chargeback or dispute with their bank. If a chargeback is filed for a valid service rendered, the Company reserves the right to report the Client’s passport details to fraud prevention databases and relevant immigration authorities.

5. Cancellation and Refund Policy

5.1. Waiver of Cooling-Off Period: Under UK Consumer Contracts Regulations, the right to cancel (cooling-off period) does not apply to contracts for services once the performance has begun with the consumer's agreement. By submitting your application, you request immediate performance of the service. 5.2. Refund Eligibility:

  • Full Refund: If you cancel before our team has reviewed or submitted your documents.

  • No Refund: Once the application has been submitted to the Japanese Consulate system, the service is deemed "Completed" and the fee is non-refundable, regardless of the visa outcome. 5.3. Rejection Refunds: If your visa is rejected due to an error made by our staff, a full refund will be issued. If rejected due to your own ineligibility (criminal record, past overstay), no refund is issued.

6. Client Obligations and Accuracy of Data

6.1. Truthfulness: The Client warrants that all information provided in the Application Form is true, accurate, and complete. 6.2. Document Quality: The Client is responsible for providing clear, legible scans of their passport and a photo that meets the specified criteria. The Company will attempt to fix minor issues, but we are not magicians. 6.3. Certificate of Eligibility (CoE): For Student Visa applicants, the Client is responsible for ensuring the CoE uploaded is valid and matches the passport details exactly. 6.4. Legal Consequences: Providing false information to immigration authorities is a serious offense. The Company bears no responsibility for legal action taken against a Client who provides fraudulent documents.

7. Visa Issuance & Consulate Discretion

7.1. Decision Authority: The decision to grant or deny a visa rests solely with the Ministry of Foreign Affairs of Japan. 7.2. No Guarantee: MigraGlobal Soluciones LTD cannot and does not guarantee that a visa will be issued. We guarantee processing, not approval. 7.3. Visa Conditions: The issuance of a visa does not guarantee entry into Japan. Japanese Border Control officers have the final right to deny entry at the airport.

8. Limitation of Liability

8.1. Liability Cap: To the maximum extent permitted by UK law, the Company’s total liability to the Client for any claim arising out of these Terms shall be limited to the amount paid for the service ($70.00 USD). 8.2. Exclusion of Damages: The Company shall not be liable for any indirect, special, incidental, or consequential damages, including but not limited to:

  • Loss of profits or revenue.

  • Cost of alternative travel arrangements.

  • Missed flights or hotel bookings.

  • Emotional distress.

9. Intellectual Property Rights

9.1. Ownership: All content on evisajapan.co.uk (text, logos, graphics, software, forms) is the intellectual property of MigraGlobal Soluciones LTD. 9.2. Restrictions: The Client may not copy, reproduce, distribute, or create derivative works from our content without express written permission.

10. Privacy and Data Protection

We process your personal data in strict accordance with the UK GDPR and our Privacy Policy. By using our service, you consent to the transfer of your data to the Japanese Government for the purpose of visa processing.

11. Governing Law and Jurisdiction

11.1. Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of England and Wales. 11.2. Dispute Resolution: Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in London, United Kingdom.

12. Changes to Terms

We reserve the right to modify these Terms at any time to reflect changes in Japanese Immigration Law or our business policies. Continued use of the website after any such changes constitutes your acceptance of the new Terms.
